Fan Loyalty Program

PROGRAM DESCRIPTION: The Hockey East Association ("HEA") has created the Fan Loyalty Program, a fan membership loyalty program (THE PROGRAM) consisting of two tiers, an Insider tier which is a free offering and a Premier tier which is a fee-based subscription offering. The two tiers consist of differing, various categories and levels of exclusive member only benefits for example content, deals & discounts, events & experiences, special ticket offers, merchandise and other community related activities such as status, raffles and contests. The Premier level benefits are broader, more robust and greater in value.

PREMIER MEMBERSHIP PLAN AND BILLING DETAILS: Your enrollment in and membership subscription to the Premier level is subject to a membership fee (Premier Fee) which may be modified from time to time. An annual membership enrollment billed at a one-time annual fee offers Premier members designated benefits for a twelve (12) month membership period. Your Premier membership will begin immediately upon enrollment and the respective membership fee will be processed to your credit card in accordance with the terms and conditions herein at the corresponding subscription rate.

Your Premier membership offering may include special ticket offers and other immediately redeemable benefits such as reduced, member only discounted pricing to certain high-profile tournament or special season events offered by HEA , its member schools, affiliates and other third parties (collectively Key Events) held from time to time throughout the year. You agree and acknowledge that Key Events offered through the Premier level shall be offered and designated such by Hockey East in its sole discretion and for illustrative purposes without the effect of limiting the following may include but not be limited to member only benefits relating to raffles, contests, meet & greets, playoff games, tournament games, fundraiser events, banquets, media days, championship tournaments and other such similar events and experiences. You agree and acknowledge that such Key Events made available to you as a Premier member is of unique value and as such, you agree and consent that the Premier membership fee as charged is non-refundable. For purposes of emphasis and clarity, you agree and acknowledge that under no circumstances shall refunds be issued whether you avail yourself or realize such benefit. Your subscription will renew automatically at the end of each membership period pursuant to your specific enrollment period. We will provide you a renewal notice via email thirty (30) days prior to the expiration of your current membership period. Unless you choose to not renew and cancel your membership subscription, the then current fee for your Premier membership will be billed to your payment method on file. Limitation of Liability. TO THE EXTENT NOT PROHIBITED BY APPLICABLE LAW, IN NO EVENT SHALL HEA, ITS PROGRAM AFFILIATES, ITS MEMBER SCHOOLS OR ANY THIRD PARTY PARTICPATING IN THE PROGRAM BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, ARISING OUT OF OR RELATED TO YOUR MEMBERSHIP IN CONJUNCTION WITH THE PROGRAM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU. In no event shall THE TOTAL LIABILITY to you for all damages (other than as may be required by applicable law in cases involving personal injury) OF HEA, ITS PROGRAM AFFILIATES, ITS MEMBER SCHOOLS OR THIRD PARTY PARTICIPATING IN THE PROGRAM exceed the amount of your then current Premier Membership Fee. The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.
